1. "consumer" means the person completing the Travel Quoter enquiry form.
2. "enquiry form" means the Travel Quoter enquiry form.
3. "product or service provider" means the travel agent, travel agency or provider of any service or product advertised on this website or made available via this website.
4. "quote" means a price provided by a product or service provider on the basis of the information you have provided in the travel enquiry form.
5. "you" / "your" means the person who proposes to use or is using this website.
6. "service" means forwarding the Travel enquiry form to your selected suburb/radius product or service provider.
7. "we" / "us" / "our" means TRAVEL QUOTER PTY LTD trading name of TRAVEL QUOTER and any other person or business to whom we may legally transfer our rights under these Terms and Conditions.
8. "website" means a site on the world wide web located at www.travelquoter.com.

3. Use of this Website

By using this website, you acknowledge and understand that:

1. We take no responsibility for computer viruses or other computer related problems you suffer as a result of using this website. We recommend that you use your own appropriate virus checking software.

3. We cannot guarantee the continuous or fault-free operation of our website and/or the service we provide you with. Without limitation issues may include: systems or technological failure or delay that may impede or prevent access to the Website and/or other services.

5. When dealing with a product or service provider(s), it is your sole responsibility to check their terms and conditions and privacy statement. The product or service provider's terms and conditions and privacy statement will cover any transaction or agreement between you and the product or service provider, if any. 1. We provide a service that enables you to complete an enquiry form that is then sent to the product or service provider(s) of your selected suburb(s)/radius(s).
2. You acknowledge and understand that we are not a product or service provider and that the relationship between you and us is not one of an agency, but merely a conduit between you and the product or service provider(s).
3. You acknowledge and understand that we make no warranty as to the accuracy or reliability of the product or service providers.
4. You acknowledge and understand that we accept no responsibility for the product or service provider(s) conduct, advertising errors, products and services (including reliability or standards of those products and services), information, or representations to you.
5. In providing you with our service we are not able to guarantee the availability of any specific product, price nor quality of service you will receive from the product or service provider. You will need to deal directly with the product or service provider to make any enquires and/or purchase(s).
6. There is no limitation as to the number of enquiry forms you are allowed to submit.
7. We do not charge you a fee for your use of our service. You may need to pay any fees or charges in accordance with any agreement you enter into with any of the product or service provider.
8. We do not provide any financial, travel, legal and/or other advice in relation to the product or service, nor do we provide a recommendation or endorsement of any product or service provider.
9. You consent to us sending your enquiry form to the product or service provider(s) registered for our service who fall within the suburbs/radius selected by you. The product or service provider(s) will contact you directly and discuss their services.
10. The retainer of our service is only limited to enabling you to complete the enquiry form and sending this enquiry form to the product or service provider(s) of your selected suburb/radius.

6. Intellectual Property

1. All information, data and copyright material contained on this website, including any trade marks (whether officially registered or unregistered), trade names, brands, logos and devices belong to us or to people whom we have given ownership or permission to use such information data and/or copyright material. You must not use such information or copyright material unless you have written permission from us or the owner to do so.
2. You may not download or copy any of the content and other downloadable items displayed on this website without prior consent from us.

8. Termination

You agree to indemnify and hold us and our affiliates (and their officers, agents, partners and employees), if any, harmless against any and all loss, liability, claim or demand (including reasonable legal fees) arising out of, or in connection with your use of and access to the website and service including but not limited to where such use and access is not in accordance with these terms and conditions, or relates to your failure to meet your obligations under your agreement with the consumer(s).

10. General Provisions Relating to Rights and Remedies

2. Our rights and remedies provided in this Agreement are in addition to other rights and remedies given to us by law and equity independently of this Agreement.
